This course ensures that you will have the knowledge to manage both small- and large-scale retrenchment processes in line with the Code of Good Practice on Dismissals, ensuring both procedural and substantive fairness, as per the Labour Relations Act.

Introduction

The course outlines the mandatory consultation process for employers considering dismissals for operational reasons (retrenchment), requiring fair, transparent consultations with employees or unions to try and avoid or minimise job losses, covering reasons, alternatives, selection criteria, and severance pay, so as to ensure procedural fairness to prevent unfair dismissal claims.

Who is this course aimed at?

Line Managers, HR Professionals, and Union Representatives.

Course content and outcomes

At the conclusion of this course, the delegate should understand:

  • How to implement a Section 189 process according to the Labour Relations Act (LRA);
  • The requirements of a Section 189(3) notice to initiate meaningful engagement before any final decision is made;
  • Understand the rules that apply to companies employing less than 50 employees and those employing more than 50 employees;
  • How a severance package is calculated;
  • What constitutes unfair retrenchment;
  • What recourse is available for an employee who is unfairly dismissed.

Accreditation

This course is accredited by SABPP, and CPD points will be awarded to delegates who complete the course.

  • PLUS a daily fee for each additional delegate of R3 000.00
