This course is specifically designed to empower Employment Equity and Skills Development Forums to develop the knowledge and skills required to meet the employer’s statutory requirements relating to Employment Equity and Skills Development.

Designated employers are required to fulfil their statutory obligations as prescribed by the Employment Equity Act, 55 of 1998 (EEA).

To fulfil these obligations, the employer requires a well-trained Consultative Employment Equity and Skills Development Forum (EEF). Skills Development plays a critical role in identifying and implementing affirmative action measures and integrating these two concepts.

What must a designated Employer do in order to implement affirmative action measures?

  1. Consult with employees;
  2. Conduct an analysis;
  3. Prepare an employment equity plan;
  4. Report to the Director-General of Labour (Director General) on progress made in the implementation of the plan.

Background: Employment Equity & Skills Development Legislation

The Skills Development Act 97 of 1998 aims to improve the skills of the South African workforce through structured training and learnerships, establishing a framework for skills development and funding; as well as programmes and strategies aimed at accelerating skills development. As indicated above skills development and employment equity are inseparable interventions and are in fact critical strategies for the National Development Plan.

The recently enacted Employment Equity Amendment Act 4 of 2022 (EEAA) has introduced further obligations in the EEA to accelerate equity in the workplace: The amendments introduce sectoral numerical targets to ensure equitable representation of historically disadvantaged groups based on race, gender, and disability at all occupational levels in the workforce.

In this regard, the Department of Employment & Labour (Department) has published Regulations which provide guidelines for employers. In addition, the Department published the above-mentioned sectoral targets to enable employers to compile their Employment Equity Plans for the prescribed period 1 September 2025 to 31 August 2030.
